Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Pokertally ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Pokertally ("we," "us," or "our").

2. Description of Service

Pokertally is a poker session tracking application that allows users to:

  • Log and track poker sessions including buy-ins, cashouts, and duration
  • View statistics and analytics about their poker performance
  • Share game sessions with other players
  • Settle up winnings and losses with other players

3. Eligibility

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. The App is designed for tracking poker games that are legal in your jurisdiction. You are solely responsible for ensuring that your use of the App complies with all applicable laws and regulations.

4. User Accounts

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. Acceptable Use

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Submit false, misleading, or fraudulent information
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Use the App for any illegal gambling activities
  • Create multiple accounts for fraudulent purposes

6. User Content

You retain ownership of any content you submit to the App, including session data, player notes, and profile information. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the Service. You are solely responsible for the accuracy and legality of the content you submit.

7. Subscriptions and Billing

Pro Subscription

Pokertally offers a Pro subscription that provides access to premium features. By subscribing to Pro, you agree to the following terms:

Billing and Auto-Renewal

Pro subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You will be charged the subscription fee through your Apple App Store or Google Play Store account.

Free Trials

We may offer free trial periods for Pro subscriptions. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription, and you will be charged the applicable subscription fee. You may only use one free trial per Apple ID or Google account.

Cancellation

You may cancel your subscription at any time through:

  • iOS: Settings → Apple ID → Subscriptions → Pokertally
  • Android: Google Play Store → Menu → Subscriptions → Pokertally

Cancellation will take effect at the end of your current billing period. You will retain access to Pro features until that date. We do not provide prorated refunds for partial billing periods.

Refunds

Refund requests are handled by Apple (for iOS) or Google (for Android) in accordance with their respective refund policies. We do not directly process refunds for in-app purchases. To request a refund, please contact Apple or Google support.

Price Changes

We reserve the right to change subscription prices at any time. Any price changes will take effect for your next billing cycle after we provide you with reasonable advance notice. Your continued use of the subscription after the price change constitutes your agreement to pay the updated price.

8. Financial Information Disclaimer

The App is a tracking tool and does not provide financial, legal, or tax advice. Any statistics, projections, or calculations provided by the App are for informational purposes only. You should consult with qualified professionals regarding any financial decisions. We are not responsible for any financial losses that may occur as a result of your poker play or reliance on information provided by the App.

9. Intellectual Property

The App and its original content, features, and functionality are owned by Pokertally and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

10. Third-Party Services

The App integrates with various third-party services to provide its functionality. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

Key third-party services we use include:

  • RevenueCat: Manages subscription billing and entitlements. RevenueCat processes your subscription status and purchase history but does not have access to your payment card details, which are handled by Apple or Google.
  • Supabase: Provides secure cloud database and authentication services for storing your account and session data.
  • Firebase Crashlytics: Crash reporting service (opt-in only) to help us identify and fix app stability issues.
  • TelemetryDeck: Privacy-first analytics service that collects only anonymized, non-identifying usage data.
  • Apple App Store / Google Play Store: Handle payment processing, subscription management, and app distribution.

Data Protection Safeguards

We have Data Processing Agreements in place with all third-party processors that include:

  • GDPR compliance obligations
  • Standard Contractual Clauses for international transfers
  • Your GDPR data subject rights
  • Breach notification requirements

10B. Data Controller and Your GDPR Rights

Pokertally as Data Controller

Pokertally acts as a data controller for the personal data you provide to us. This means we are legally responsible for processing your data in accordance with GDPR and Finnish data protection law.

Your Rights Under GDPR

You have the following rights:

  • Right to Access (Article 15): Request a copy of all your personal data
  • Right to Rectification (Article 16): Correct inaccurate information
  • Right to Erasure (Article 17): Request deletion of your data
  • Right to Restrict Processing (Article 18): Limit how we use your data
  • Right to Data Portability (Article 20): Receive your data in a standard format
  • Right to Object (Article 21): Oppose certain types of processing

Complaints to Supervisory Authority

You have the right to lodge a complaint with the Finnish Data Protection Ombudsman (Tietosuojavaltuutettu) if you believe we are not complying with GDPR. Visit tietosuoja.fi or email tietosuoja@om.fi.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKERTALLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP.

13. Indemnification

You agree to indemnify and hold harmless Pokertally and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

14. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time through the App settings.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.

For disputes, you and Pokertally agree to:

  • First attempt to resolve the dispute informally by contacting support@pokertally.app
  • If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of Finnish courts

You also have the right to lodge a complaint with your national consumer protection authority or the Finnish Data Protection Ombudsman.
